TERMS & SMS CONDITIONS

Welcome to After Party. These Terms & Conditions govern your use of the After Party website, attendance at our events, purchase or use of tickets associated with our events, and participation in our mobile messaging program.

After Party is operated by AfterPartyTexas LLC (“After Party,” “we,” “us,” or “our”). By purchasing a ticket, registering for an event, using our website, attending an After Party event, or opting into our mobile messaging program, you agree to these Terms & Conditions.

1. Ticket Sales

All ticket sales are final unless otherwise stated.

Tickets may not be duplicated, fraudulently reproduced, or used more than once. We reserve the right to invalidate tickets that we reasonably determine were obtained fraudulently or in violation of applicable ticketing terms.

Purchasing a ticket does not waive venue rules, age restrictions, identification requirements, security procedures, or other conditions of entry.

2. Refund Policy

All sales are final. No refunds will be issued unless an event is cancelled, except where otherwise required by applicable law.

Refunds will not ordinarily be provided because of personal scheduling conflicts, failure to attend, transportation issues, failure to meet age or identification requirements, removal from an event for violation of event or venue rules, or dissatisfaction with individual performers, schedules, or programming.

If an event is postponed or rescheduled rather than cancelled, tickets will generally remain valid for the rescheduled event. Any additional options will be communicated to affected ticket holders.

3. Event Changes

Event details are subject to change.

After Party may modify event dates, times, venues, performers, DJs, programming, production elements, attractions, or other event details when reasonably necessary.

Changes to individual performers, programming, production elements, or event schedules do not automatically entitle a ticket holder to a refund.

4. Age Requirements

Age requirements vary by event and will be stated on the applicable event listing.

Many After Party events are 18+, but customers are responsible for confirming the age requirement before purchasing a ticket.

5. Identification

Guests may be required to present a valid, physical, government-issued photo ID.

Failure to provide acceptable identification may result in denied entry without a refund.

6. Admission & Capacity

Admission is subject to ticket validity, venue capacity, event rules, security procedures, age requirements, and applicable law.

After Party and participating venues reserve the right to refuse admission or remove individuals when reasonably necessary for safety, security, legal compliance, or enforcement of event or venue rules.

Being in line, possessing an RSVP, or receiving a promotional registration does not necessarily guarantee admission. Paid tickets will always be the priority.

7. Security & Prohibited Conduct

Guests may be subject to reasonable security screening before entering an event.

Weapons, illegal substances, dangerous items, and other items prohibited by the venue or event are not permitted.

Threatening behavior, violence, harassment, property damage, unsafe conduct, or other conduct that materially interferes with the event may result in removal without refund and, where appropriate, referral to law enforcement.

8. Re-Entry

Unless explicitly stated otherwise for a particular event, re-entry is not permitted after leaving the venue.

9. Photography & Recording

Photography, video recording, and other media capture may occur at After Party events.

By entering an event, you acknowledge that you may incidentally appear in photographs, video, or other recordings captured in public event areas. To the extent permitted by applicable law, such media may be used for legitimate event documentation and promotional purposes.

Professional or commercial photography and recording may require prior authorization.

10. Personal Property

Guests are responsible for their personal belongings.

To the extent permitted by law, After Party is not responsible for lost, stolen, forgotten, or damaged personal property except where liability cannot legally be excluded.

11. Assumption of Risk

Live entertainment and nightlife environments may involve inherent risks, including crowds, loud sound, flashing or strobe lighting, physical activity, and interactions with other attendees.

By attending, guests voluntarily assume the ordinary risks associated with attending such events, except to the extent liability cannot legally be limited or excluded.

12. Third-Party Services

After Party may use third-party ticketing providers, payment processors, venues, mobile messaging providers, and other service providers.

Those services may be governed by their own terms and privacy policies.

13. Website Use

You may not use our website to engage in fraud, interfere with website operation or security, distribute malicious software, impersonate another person, violate applicable law, or misuse After Party intellectual property.

14. Intellectual Property

The After Party name, logos, graphics, event concepts, website content, photographs, videos, promotional materials, and other original brand assets may be protected by intellectual property laws.

Nothing on this website grants permission to use After Party intellectual property for commercial purposes without authorization.

15. Limitation of Liability

To the fullest extent permitted by applicable law, After Party and AfterPartyTexas LLC will not be liable for indirect, incidental, special, or consequential damages arising from use of the website or attendance at an event.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

16. Mobile Messaging Program

AfterPartyTexas LLC and its affiliates (“We” or “Us”) are offering a mobile messaging program (the “Program”), which you agree to use and participate in subject to these SMS Marketing Terms and Conditions (the “Terms”).

By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions.

17. User Opt In

Program allows users to receive SMS/MMS mobile messages or other marketing and informational communications by opting into the Program, such as through online or application-based enrollment forms or by texting a keyword to one of our phone numbers (such as a traditional 10-digit phone number or a toll-free number) or “short codes” (a 5 or 6-digit number that We use to exchange SMS/MMS with you), to which you may need to respond to confirm your opt-in.

Regardless of the opt-in method you used to join the Program, you agree that these Terms apply to your participation in the Program.

By participating in the Program, you agree to receive text messages, including automated text messages, at the phone number associated with your opt-in, and you understand that consent to these terms is not required to make any purchase from Us.

While you consent to receive messages and calls sent using an autodialer, this shall not be interpreted to suggest or imply that any of Our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”), and you and We agree that the system we use to send Our messages is not an ATDS.

18. User Opt Out

If you do not wish to continue participating in the Program or no longer agree to these Terms, you agree to reply STOP, UNSUBSCRIBE, REMOVE, CANCEL, END, QUIT, OPT OUT or ARRET to any mobile message from Us to opt out of the Program.

You may receive one additional mobile message confirming your decision to opt out.

You understand and agree that these opt-out options are the only reasonable methods of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.

19. Support Instructions

For further opt-out support, please contact our SMS platform provider, SlickText, at support@slicktext.com.

20. Cost and Frequency

Although We do not charge you for our messages, message and data rates may apply from your wireless carrier.

The Program involves recurring mobile messages, which may vary in frequency based on, among other factors, your level of interaction with Us.

21. MMS Disclosure

The Program will attempt to send SMS MTs (terminating messages) if your mobile device does not support MMS messaging.

22. Mobile Messaging Disclaimer of Warranty

The Program is offered on an "as-is" basis and may not be always available in all areas and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with this Program. Carriers are not liable for delayed or undelivered mobile messages.

Participant Requirements

You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.
